erms & Conditions / Contract for Breanna Leigh Designs

1. Overview

These Terms and Conditions (the "Agreement") outline the responsibilities, rights, and expectations between Breanna Leigh Designs ("Designer") and the Client". By purchasing a template, custom website, or any digital product or service, the Client agrees to the terms below.

2. Services Provided

Breanna Leigh Designs offers:

Custom website design Sales Page (Showit)

VIP day services

Copywriting (beginner-level)

Animations and custom add-ons

3. Payment Terms

Payment is due upfront unless a payment plan is offered.

Payment plans must be completed in full. Failure to complete payments may result in suspension of services or access.

All payments are non-refundable due to the digital and service-based nature of the work.

Designer is not responsible for additional platform fees (e.g., Shopify apps, Squarespace plans, hosting fees).

4. Timeline & Client Responsibilities

Designer Responsibilities:

Deliver work based on the agreed timeline.

Communicate updates and revisions within reasonable business hours.

Client Responsibilities:

Provide all content (text, photos, brand assets) by the requested deadlines.

Respond within 2 business days to maintain project timeline.

Any delay in Client deliverables may extend the project timeline.

5. Revisions

Templates include no revisions.

Custom website packages include 1–2 rounds of revisions depending on the package.

Additional revisions may be billed at an hourly or flat rate.

Revisions must be requested within 7 days of delivery unless otherwise agreed.

6. Template License

Templates purchased from Breanna Leigh Designs include:

One license for one website per purchase.

You may not share, resell, redistribute, or claim the design as your own.

The Client may customize the template for their own business.

Unauthorized resale or redistribution may result in legal action.

7. Ownership & Intellectual Property

Designer retains ownership of all design assets, graphics, templates, and layouts until the project is paid in full.

Upon full payment, the Client receives rights to use the completed website for their business.

Designer may showcase the project in portfolios, marketing materials, social media, and advertisements unless Client requests otherwise in writing.

8. Tech Platforms & Third-Party Tools

Client understands:

Designer is not responsible for third-party outages, updates, or platform changes.

Any additional tools, plugins, integrations, or subscriptions are the Client’s responsibility.

9. Communication

All communication will be via email, Instagram DM, or agreed messaging channels.

Business hours: Monday–Friday unless otherwise stated.

Response time is typically 24–48 hours.

10. Cancellations & Refunds

All purchases are non-refundable.

If the Client cancels a project mid-way, no refund will be given for work already completed.

If the Designer must cancel due to emergency or unforeseen issues, Client will receive a partial refund based on remaining undelivered work.

11. Client Satisfaction

Designer will make a reasonable effort to ensure Client satisfaction.

Client acknowledges design is subjective.

Client agrees to communicate feedback clearly and respectfully.

12. Liability

Designer is not liable for: lost revenue, sales decreases, SEO changes, hacked sites, domain issues, hosting problems, or third-party errors.

Client is responsible for maintaining their website after launch (unless upkeep/retainer services are purchased).

13. Website Launch

Designer will assist with launch (if included in the package).

After launch, any changes or fixes are billed as additional work.

14. Confidentiality

Both parties agree to keep sensitive business information confidential.

15. Termination of Agreement

This agreement may be terminated by Designer if:

Client fails to pay

Client is unresponsive for 7+ days

Client behaves disrespectfully or violates terms

16. Acceptance of Terms

By purchasing, booking, or signing up for services, the Client acknowledges they have read and agreed to all terms listed in this Agreement.
